Overview

The Board of Commissioners is the county's legislative body. It also serves as the chief administrator for several important county operations, and is authorized by the State of North Carolina to exercise and discharge legislative responsibilities within the county.

The Board of Commissioners' primary duty as the county's legislative branch is to match the county's revenue with expenditures in adopting an annual balanced budget for the entire county. Each of the separately elected officials is responsible for adhering to the adopted budgets affecting his/her office. The Commissioners are responsible for the operation of budgets under the control of various appointed department heads.

Also within the legislative capacity, the Commissioners are responsible for adopting, amending, and repealing all county ordinances. These include traffic, zoning, planning and public safety ordinances, as well as any other ordinances concerning the general welfare of the county.

Newly elected members take office on the first Monday in December, following the election in even-numbered years. A chairman is selected by the board from among its members. The board meets the second Monday of each month at the Yancey County Courthouse, and at other times designated by the Board and notified to the public. All meetings are open to the public, and so are the minutes from the meeting.

Public Records

A public record is information created or received while transacting the public business by any agency of North Carolina government or its subdivisions. North Carolina's public records law provides a very broad definition of what is a public record and stipulates that anyone can request a public record for any reason.
